Debt Enforcement and Bankruptcy

The Firm assists its clients, whether debtors or creditors, at all stages of enforcement, realization, or compulsory execution proceedings concerning a claim, a Swiss or foreign judgment, or an arbitral award.

The Firm regularly represents the interests of debtors, creditors, and bankruptcy estates, particularly in payment actions, liability claims in bankruptcy, and clawback actions. It also defends the interests of property owners and mortgage creditors in proceedings for the realization of real estate and movable property collateral, as necessary to safeguard their rights.

The Firm’s services notably include:

  • Identifying debtors and obtaining financial and asset-related information;
  • Filing debt collection requests, applications for release from opposition, seizure orders, and bankruptcy petitions;
  • Lodging complaints against any irregular actions of debt enforcement and bankruptcy offices;
  • Conducting substantive proceedings in enforcement matters, such as debt release actions, proceedings for the annulment of enforcement measures, and actions challenging the schedule of claims or the statement of charges, among others.
